Why isn't he considered a conservative?

I'm not sure why the OP posted a clip of half the interview. Here's the entire conversation with Ted Olson:

YouTube - ‪Gay Marriage Lawyer Ted Olson (8.8.10)‬‎

Also, here's a great article he wrote:

Also, the people claiming Ted Olson is not conservative are nuts. The man is one of the FOUNDERS of the Federalist Society - the preeminent conservative legal group in the nation.

I have little doubt that when Ted Olson argues this case at the Supreme Court he'll have very little problem convincing all of the Justices of his position - including his friends and fellow Federalist Society members Justices Scalia, Roberts, and Alito. The man has the law on his side.

For those of you too impatient to watch the video, here's one of the last things Olson says. I think it's particularly poignant:

"We also believe that is an important conservative value that we sustain the rights of liberty of our citizens and eliminate discrimination on invidious biases whether it's race or sex or sexual orientation. It should be a liberal and conservative value. It is a fundamental American value that all men and all women are created equal under the law."

I'm waiting for Fox News to interview vice president Cheney, the patriarch of the GOP, and tell him that his daughter and grandchildren that he dearly loves are illegitimate. It's great for bigotry to be put on display each day Fox News peddles its hate and ignorance. The entire Republican party is on trial for unconstitutional malpractice. Watching the conservatives get pealed away from the Republican party one by one is a pleasure to witness.

Too bad such rational positions never get much attention. Is it because he is a conservative that the so-called conservatives on CD don't want to comment on it?
But hey, apparently he is not a conservative but no one has explained why he isn't.

I thought conservatives were in favor of keeping the government out of our personal lives. All of the bans on same-sex marriage are obviously an intrusion into the personal lives of millions of Americans.

If you believe in freedom, you have to be against bans on same-sex marriage. If you don't approve of same-sex marriage, then don't marry someone of the same sex. Pretty simple.

Only if those freedoms operate within their moral compass, then it's time to legislate people into submission.

Fiddling while Rome burns. Who gives a crap about gay marriage when unemployment is at 10%, there is record deficits, record debt and a very uncertain future for the children of the US.

Liberals get stuck in eddy currents. "Gay marriage" is issue # 334 on the number of issues which are important to voters and citizens of the US. Any focus on this "issue" (no one really cares whether gays marry or not or what the hell they do in thier homes) is just a diversion for the miserable failure of the economic policies of Obama.

Let the gays marry. Impeach Obama.
