Doesn't the Communist state of Illinois have distracted driving laws? I don't understand how this is not negligent manslaughter.

He should be held to a higher standard than the average citizen given his LEO position. I hope the girls' families go after this sorry loser but big time as well as the IHP.

A few yrs back a cop in highland, ca was speeding with no siren & lights on & he hit & killed a woman. The cop was never charged with anything & hes still a cop today. The family of the victim was treated like dirt.

If anyone can find the news article please post it. Public servents get away with more then you think. Think about it this way. They all basically work for the same people. Ill scratch your back if you scratch mine.

He was "probably" texting (per the Prosecutor). Mitchell pleaded guilty and was convicted of reckless homicide and aggravated reckless driving. He was given probation. An incredibly light sentence, I agree, but one that the girls' parents were consulted on and agreed with.

I watched the trial on CourtTV. I think the trial occurred over three years ago, so you will have to dig for the info if you care to check it out.

He retracted his guilty plea because of the civil suit. Two different animals between criminal and civil. So, clearly the family are suing the police department as it states in the OP's article.

If he retracted his plea can he not be retried?

If armageddon ever comes i bet the cops will be running like scared lil school girls. Im thinking about buying a gun for home/property protection but im not sure why type to buy if i do.

I don't believe so. The criminal trial is over. You can't plead guilty and then start saying "I'm not guilty" after the fact (where new evidence comes to light, I believe is when a person can be retried).

the article's talking about the civil trial and the worker's compensation trial as I read it. I don't think they have anything to do with the criminal trial.
