Makes you wonder why we bother to hold elections, since judges can just tell us what the law will be. Send those 535 expensive Members of Congress and their million dollar (each) staff budgets home. They've obviously become unnecessary!!

Yes, judges can tell us what the law will be (by interpreting existing laws passed by the Legislature). Read up on your Constitution, specifically Article III.

We hold elections to choose representatives who will enact new laws. Those representatives are sworn to uphold the Constitution. The Judiciary is empowered to rule on cases of law, including cases challenging laws.

The electorate cannot overrule the Constitution, unless they go so far as to have their representatives and the required number of states to amend it.

Default Judge Orders Military to Stop Enforcing Don't Ask Don't Tell

Congress passes a law to ____________________, the President signs it. A number of Americans are upset about the law. They claim it is unconstitutional, and a group of opponents files suit. Their case is heard in a Federal District court. The judge rules that the law is unconstitutional and void. Conservatives proclaim _____________________.

Now, fill in the blanks.

Situation One
Law: "require gay service members to not reveal their orientation"
Conservative Response to overturning: Judicial activists. No reason to have elections any more. Will of the people worthless. Judges usurping the Executive and Legislative.

Situation Two
Law: "require Americans to purchase health care insurance"
Conservative Response to overturning: Proper. Will of the people. Constitutional. Justice.
