The EPA cannot dictate policies... Congress does... anything the EPA trys to do is unconstitutional they are appointed not elected.
The EPA went to court and the Supreme Court decided they can regulate CO2 emissions under the current Clean air Act. Until it is amended they most certainly can regulate it or try to.
