This presents an interesting case of First Amendment vs. Fourth Amendment balancing tests.
Gov't has the burden of showing that there is a compelling gov't interest in searching underneath the head covering versus not only burdening religious practice but also privacy search concerns.
In airports the 4th amendment privacy concerns side is more relaxed in favor of the government. Flying is optional. My guess is that a federal court will rule in favor of the gov't because one does not have the right to fly if there are other transportation options available.
Because they are the threats. So we fear them and cower to them....
I am going to start traveling with a full-bodied muslim garb when I travel. That way, I'll be left alone....

I want to start an airline company called WPA (We Profile Airlines) "No full-body scanners, No patting downs. Just good old profiling!"

I would just imagine that the TSA website is overwhelmed with "brave men and women" willing to grope and grab for their country and not needing any formal qualifications.

Absolutely right. I spend years telling my kids that no one is aloud to touch them, except a doctor when I am in the room and now I have to say that it is okay for a perfect stranger go grab them there? I don't think so.
I have a feeling that unless I look muslim, that if I say that it is against my religion, they will just ignore me. But if I walk in there and all you can see is my eyes, they will let me pass, I think that I am going muslim on the days that I need to fly.

That guy didn't even have a ticket or a passport. That should have been red flag number one. I'm glad that all he burned up was his junk.
