While combing threw Foreign Policy I ran across an article regarding the Espionage Act by Paul Miller discussing the need to update the Espionage act in order to deal with issues such as the recent Wikileaks.

In the article, Miller quotes Supreme Court Justice Byron White stating in effect that had the government prosecuted the NYT's instead of seeking to place prior restraints to keep it from publishing the Pentagon Papers, he would have voted, upon appeal I suppose, for upholding such a conviction.

I posted this because I found it to be a surprising argument that wasn't brought up on any of the Wikileak threads.
