Jeff Sessions (R-AL) railed against President Barack Obama's nominees to the federal bench on Tuesday afternoon, complaining that Obama was only nominating individuals with "ACLU DNA" and rattling off a list of potential judges who are now or have ever been a member of the American Civil Liberties Union.
"I'm sure that less than one percent of the lawyers in America are members of the ACLU," Sessions said. "It seems if you have the ACLU DNA, you get a pretty good leg up to being nominated by this president."...
That's not really that dumb of a comment. It is his opinion and there surely is some basis for what he is saying. Obama nominated 2 activist judges to the SC who are very involved with social justice.

No, you are talking about different OPINIONS. Judges don't rule on OPINION, they rule on the LAW, Constitutional law for the SCOTUS. An activist judge is someone who RE-INTERPRETS the Constitution to match their agenda. That's what those 2 will be doing.

There are conservative and liberal judges and justices with whom I disagree. But since I have some experience with judges and know how they think, I know better than to call them activist.
You might find one or two every now and then that oversteps their bounds, and you will find as many conservatives as liberals that do this. In fact the first third or so of the 20th century was dominated by conservative "activist judges", whatever that means.
You and your kind are just so steeped in and infected by ideology that you aren't capable of looking at legal issues objectively.
Point of nomenclature: appellate court decisions are referred to as "opinions" in legal parlance.
Also, other courts besides the SCOTUS rule on constitutionality all the time. In fact, except for a very few kinds of cases for which the SCOTUS has "original jurisdiction", every constitutional (and other) cases they hear bubble up through the system, ultimately from the trial courts.

When those same 2 judges dissent over the 2nd ammendment which they DID, they are clearly activist judges ignoring the Constitution and trying to change laws based on their ideology, not real Constitutional law. They are going to become a problem in the future IMO.

Is Justice Bybee of the 9th Circuit Court an "activist" judge? After all, it was he who wrote the infamous "Bybee Amendment" which made the case that the Constitution pretty much allows the Commander in Chief to do anything he damn well pleases, including ignore Congress, torture our enemies and throw US citizens into a literal dungeon and keep them there forever, without charge.
