No matter what you're opinion is on this issue, Obama is overstepping his legal boundaries. He is acting like he is a King, He has no right to order the DOJ to not defend a law that was passed congressionally. He should be following the legal process. You know "checks and balances."
But, just like the Dems in Wisconsin, he apparently doesn't believe in our system of government anymore.

The justice department is NOT supporting gay marraige. What the DOJ has been instructed to do is to not defend the current law when it is challenged on a constitutional basis in federal court. The law still stands. If your state decides that gay marraige is legal....the federal government still will not recognize it or bestow the same "benefits" on it such as survivor rights to an estate etc. Obama seems to be in transition on his feelings about gay marraige.....I wonder why he doesnt have the stones to just come out and say he supports it?....perhaps he is afraid of the political fallout??

Attorney General Eric H. Holder Jr. sent a letter to Congress on Wednesday saying that the Justice Department will now take the position in court that the act should be struck down as a violation of same-sex couples’ rights to equal protection under the law.
“The president and I have concluded that classifications based on sexual orientation warrant heightened scrutiny and that, as applied to same-sex couples legally married under state law,” a crucial provision of the act is unconstitutional, Mr. Holder wrote.
This president is an absolute freaking moron. Oil at $100 a barrel. The mid-east is falling apart. Our fragile economy is teetering and our jackass-in-chief is worried about gay marriage.
The man is a guaranteed one-termer and with any luck this country won't vote another Democratic candidate into the WH for the next 50 years.

Furthermore, pursuant to the President’s instructions, and upon further notification to Congress, I will instruct Department attorneys to advise courts in other pending DOMA litigation of the President's and my conclusions that a heightened standard should apply, that Section 3 is unconstitutional under that standard and that the Department will cease defense of Section 3.
The feds will no longer defend SOMA section 3 in court. It will however remain the law until it is overturned in court or reversed by the legislature. Nothing of substance has happened for gay marraige YET. Same sex couples still cant inherit their partners property tax free or several other benefits afforded to opposite sex married couples.
Obama is preparing to avoid the supremes. if the DOJ won't argue the case then the only people who will have already lost in Federal Court.
I would suspect that congress will appoint someone as a "friend of the court" to continue to defend the law until it is determined to be unconstitutional or otherwise.
