Once the mandatory portion is dropped the courts cannot stop it since nothing else is Un-Constitutional. Get used to the idea health care reform will happen.

You cannot pick and choose which provisions in the healthcare bill can be kept or abolished, it's an all or nothing bill. If any portion of the bill is found to be illegal, the bill in it's entirety must be revoked.

If the appeals court affirms the lower court's ruling, the case does not automatically go to the Supreme Court. The Supreme Court chooses the cases it hears, and since previous Supreme Court rulings are cited, it isn't likely the Supreme Court will hear the case.
Even if the Supreme Court heard the case, it would have reverse its previously rulings on Interstate Commerce. The Supreme Court has only reversed its rulings twice, and those were cases involving the slavery.

The mandate to force insurance companies to accept pre-existing conditions could be ruled unconstitutional as well.

The Justice Department said in a filing this week that expedited treatment of the case was warranted because of the far-reaching nature of the decision by a federal judge who declared the entire law unconstitutional.
