If its not in the Constitution as a power to regulate driving habits its left to the states and or the people.

Glad to see our representatives (I use that term loosely) hard at work to take care of the unprecedented challenges facing our country right now. 'Cuz we all know that the driving age in South Dakota is the biggest problem our country is looking at.
As usual, they're bribing the states by threatening to pull their highway funding:
"Under the proposed rules, each state will have a three-year window to bring their driving policies in line with the federal standards or face losing up to 10 percent of their federal highway funding."
Typical.
Once again, the federal government is trying to force a one-size-fits-all law on a nation that's as geographically and culturally diverse as anyplace in the world. When are they going to learn that with most things, doing that is a Bad Thing™? I mean, it's worked amazingly well with education , so I can see why they would want to apply that to everything, but at some point we need to ask our officials, "WTF are you doing?!?"
I remember when the federal Transportation Department threatened my state with a partial defunding of federal highway money, unless WI lowered the limit of BAC for drunk drivers.
It's a vicious circle, they overtax the people in the states, and then hold this diverted tax money over their heads unless states buckle to the whims and desires of this quasi-fourth branch of government.

Sure, they can talk to the government, but - if it's the case - the government has a responsibility to be transparent about WHY they're introducing the bill. The stated reason is to reduce driving related deaths.

Yep, that's how they got .08% to be a national standard. Same with the drinking age being 21 - I think Hawaii was the last holdout on that one.

Of course, nobody would have thought forcing Americans to buy an expensive product from for-profit Big Businesses was within the power of the federal government either, but that didn't stop Washington politicians from passing Obamacare (while exempting themselves, their staffs, and favored contributors like organized unions from same).
