You sign a contract with a promise to pay, then don't pay. That is theft.

Why are these people not prosecuted?

Does the public not realize that we end up paying for these cooks?

Darren Thomas is a thief. He stole the bank's money... he just didn't use a gun.

Does the contract clearly define the threat of prosecution?

I cannot default on my mortgage why should he be allowed to do so? He signed a contract to pay the money back. Too bad if his collateral won't cover all of the loan. He still owes.

It doesn't have to. Theft is a crime even without a written contract.

Yes you can. You can simply not write that monthly check.

No. That's breach of contract and a civil matter.

why are these people not prosecuted?

Because it's a private party matter not a crime

does the public not realize that we end up paying for these cooks?

Most of the public... has done something at some point on some matter
that someone else would like to have them called a crook for too

Ahh nope.. For once Eistein got one right..

if you GAVE him the money, with or without a promise of repayment, its not theft. There is a difference between taking something without concent, and someone giving you something with concent, its the exact opposite of one another..

But is there a law that the contract points at, defining non-payment as theft?

its only theft if the mortgage is not paid, and the person refuses to vacate the property in a timely manner when given the eviction notice. otherwise it is a civil matter.

A lot of loans are non-recourse loans.
