yep, and if they do then what the appellate court ruled will stand. however since there is conflicting rulings from appellate courts, it is quite likely that the case will be heard by the SC.
As Obamacare heads for the Supreme Court, I am almost 100% certain that the Court is going to flush it down the toilet where it belongs. The only question to be answered by the court is if they are going to flush the WHOLE thing down the stool or just the part that forces people to buy medical insurance. The Atlanta Apellate court ruled that the rest of the law could stand. The Florida court said if one part is bad, it is all bad. I just cannot see any court allowing Obamacare to stand. Of course I was sure that court was going to rule against seizure of private property for private use but they ruled against Kelo so nobody can say for sure. I just hope if the rule against PART of Obamacare that they will flush it all down.
Without everybody (except illegals) "Buying" health care insurance, the whole plan will fall on it's own weight because without the money there is no other funding to support the rest of it.
I always thought Obama made the wrong decision to waste his early political capital on a healthcare bill that would never have passed the Constitutionality test. I think he should have used it on something more productive and beneficial like repealing the Controlled substance act (ie ending the war on drugs) or a new Manhattan Project for fusion energy.
