Why not? Do you strip search people before they get tested? I think it would work, and you're just saying it wouldn't because it tees you off that people can and do get away with it.
Good question! Nobody knows exactly why. Is it harmful? That hasn't been proven. Many legal substances have killed people, and remain legal. Does marijuana ruin lives. That can't be proven. Many marijuana users are ordinary citizens living ordinary lives and you wouldn't even know they use marijuana.
So why is marijuana illegal?

I can get in my car right now and drive it full speed into another car an kill that person. It happens everyday (mostly by accident) But I´m not going to do it.
This concept of personal responsibility can be applied to everything from poisonous mushrooms to Big Macs to shooting up the Post Office to strangling my GF to overdosing on sleeping pills to having sex with an HIV infected person to taking too much Viagara (never tried it) and dying from the hugest orgasm ever (saw that on 1000 ways to die, lol)
