An FBI advisory panel recently recommended the revision of the definiton of the term Rape from the definition established in 1927.

The Justice Department announced Friday it is revising a decades-old definition of rape to expand the kinds of offenses that constitute the crime and for the first time, include men as victims. Now, any kind of nonconsensual penetration, no matter the gender of the attacker or victim, will constitute rape -- meaning that attacks on men will be counted.
The crime of rape will be defined as "penetration, no matter how slight, of the vagina or anus with any body part or object, or oral penetration by a sex organ of another person, without the consent of the victim," a Justice Department statement said.
Just like sexual assault numbers have gone up since women were allowed to serve in the same ranks as military men.
With the repeal of DADT, there will be more homosexual rapes and assaults.
The law of averages always prevails.
It doesn't mean these crimes have not been committed in the past, just that they are now going to be appropraitely defined, and subsequent complaints and laws applied.
This definition also includes instances in which the victim is unable to give consent because of temporary or permanent mental or physical incapacity.
Furthermore, because many rapes are facilitated by drugs or alcohol, the new definition recognizes that a victim can be incapacitated and thus unable to consent because of ingestion of drugs or alcohol. Similarly, a victim may be legally incapable of consent because of age. The ability of the victim to give consent must be determined in accordance with individual state statutes. Physical resistance is not required on the part of the victim to demonstrate lack of consent.
Why do you state "be careful"? Consent, or lack thereof, is at the core of every sexual assault. An unconscious person cannot give consent.
Because it can be defined any number of ways.
I can see this happening...
'I gave consent, but only because I was afraid of the consequences. - But I really didn't want him to do it.'
What if there's partial consent? A person approves sexual activity, but the other party takes it to an extreme that is uncomfortable.
I just see the opportunity for a lot of gray area.
AND a lot of opportunity for lawyers to make more money - don't leave that out.
