The Pastor who followed Jarrett came closer to violating the law by calling out Gingrich by name, but he did not endorse or oppose Newt. Instead, he merely challenged him to address welfare reform.

What? It's not like the IRS just made up their own rules. The Internal Revenue Code (a.k.a Title 26 of the U.S. Code) was passed by duly-elected representatives in Congress in 1986. This is the law of the land.

Sorry if in replying to the question "So, why can she get away with it?" I relied on what the law states. The linked report is not specific enough and does not provide the complete context of her speech. If she didn't specifically endorse a candidate in an election then she didn't jeopardize the Churches tax-exempt status.

Unless she is some sort of official representative of that church, I see no danger to their tax-exempt status.

If people can't see how this is NOT a violation of the separation clause, I don't know what to tell them. I would be saying the exact same thing if it was a Republican who had stood up in front of a church.

As John Dark stated the IRS didn't make up the law, Congress did.

The Church is still free to say whatever it wants and support who it wants, but if it wants to engage in particular political activity it can't do so with tax-exempt donations. It is Congress (passing a law) and the President(signing the law) that determine how engaged tax-exempt organizations can be in politics.
