Yes, it was stupid, but he didn't threaten anyone. Just showed them off. You think this charge (which hopefully will be dropped when someone wakes up) will not follow this kid, even if its just that it was, for being a stupid kid????

Under Texas law, just showing a weapon is brandishing and that is a de facto threat.

when I was a kid, students drove their pickups to school with gun racks full of actuall real rifles and shotguns with real live ammo.

nobody got shot and nobody got arrested...

its a different world.

Since you were there, maybe you could tell us exactly what happened. The link in the OP was really short on the details - I'd like to know how the kid was showing off the weapons without any implied threat.

Honestly - do you think it's OK that a 12 year old who has access to weapons doesn't realize that it's a really stupid idea to bring them to school?

It was a pellet gun and a pocket knife; most probably his own.

Of course. And I don't think anyone is arguing that he should not be punished.

But do you really think he should be charged with a "terroristic threat" and booked into juvenile detention ?
The article said he was showing it to his friends. That's what I based my opinion on regarding the charge.

Schools have protocols in place for this kind of stuff. We can criticize zero tolerance overreactions all we want, but realize that they exist because of the legal considerations - there are plenty of parents and community members who would (and have) raised holy hell over lesser incidents. If a school does not follow its protocols, it is liable to legal action. It's the society we have collectively created.

That's why you can't let one kid who made a stupid mistake go. There's not enough evidence in the article to tell us how the kid was showing the gun - did he let kids take a peek in his backpack or was he waving it around recklessly? In either case, the school has to respond in the way they have planned. When you start picking and choosing incidents to enforce your rules, you're asking for trouble. Contacting the police would probably be SOP in any school for something like this.

As for the DA, they have more info about the case than you or I. On that basis alone, I can't say they are wrong in charging the kid.
