Hmm, one would have thought that such a high intellect would realize the part in the 10th Amendment that says "the powers..not prohbited by it [the Constitution] are reserved to the states..." and realized that 'shall not be infringed' is a prohibition. Perhaps not, though.

Many 10th amendment advocates I've come across seem to think that the 1st amendment doesn't apply to states, but the 2nd does. Go figure.
