I would argue that the equal protection clause of the 14th Amendment makes affirmative action unconstitutional.
Affirmative action in regards to dealing with sexism, in my case, came in the form of a tax deduction for my employer for stretching his imagination and taking a chance hiring me. He got dividends from his investment in me far beyond that tax deduction. I made him bucko bucks on the production line in large part because as female I could stand above the fray of off point male ego nonsense and cut to the quick. I facilitated smooth relations between mgmt and crew so well they spontaneously started sharing their lunch hour together. Oh that old black magic of feminine wiles. Bottom line: I never would have had the opportunity to prove myself if not for that incentive.
Those who believe affirmative action is free lunch- BS. I can assure you it's not when it's implemented properly. Had my employer incurred a loss as a result of taking a chance on me-- if I cost him more than I was producing-- he'd have no choice but to fire me. That's reality math. Not crony good old boy math that's been creeping like a choking moss into board rooms. He'd be right to fire me for lackluster performance. Simple as that. No whining.
No lawsuit was ever necessary, not even in military service, because a leader abusing their authority intrinsically loses the respect and loyalty of his entire crew. Including those witnessing his behavior from above. He shot himself in his own foot and the harder he came at me with BS the deeper the hole he dug for his own career because it hurt the whole unit. I had 40 witnesses on my side disagreeing with the marks he was giving me in front of his own chain of command. I debunked him with challenge exams applied to the whole unit and aced him at his own test. Looks to be I wasn't as addle brained/ untrainable as he tried to paint. Turns out the agenda he was serving had nothing to do with UCMJ. It wasn't easy, or pretty, but I got it done anyway. Thanks to principles & standards being upheld evenly. That's where people's loyalty belongs. Not in gender, race, creed, blah blah.
Once the doors of an industry were opened and I had a resume history in my hands, facts were facts beyond my gender. If a business put itself in the business of maintaining sexism, they're going to go out of business by their own hands because they're grievously off point from the true mission statement. They're squandering their own resources. I need only step out of their way and let them fall upon their own sword of stupidity and smirk on the sidelines of another company (not burdened with sexism) that was thriving.
Lessons learned for corporate America & US Military: Isms are exponentially unprofitable & harmful to espirt de corp. Self serving individuals in leadership positions are a recipe for doom in either endeavor.

Today we have young kids on street corners taking drugs, drinking, and getting into trouble.. when the American family HAD to pull together because of hard times and to get ahead had to share in the work to do just that... today with welfare pulling the load , one has time and money for drugs, liquor, and too much time on their hands.
There are people (of all colors, race, creed etc) who uphold the principles that founded this nation, and there are others riding on the credit of others work not upholding anything at all but self interest and exploitation. This includes maladjusted blacks, maladjusted illegals, and maladjusted whites playing their crabs in a barrel nonsense games. They'd rather not be American and I think it more pragmatic we oblige them with eviction notices.
I agree that there are people who ruin it for everybody. At the same time, I'm glad that there are laws that protect people considering all the discrimination that actually goes on out there.

A lot of employers seem to take this stance, but there's a big problem with this logic; in places where one group of people is a serious minority, of course those statistics are going to be skewed.
Take where I live and work presently for example (north Colorado); there's a little of everybody but very few black people here. I presently work in retail where it's fairly easy to replace workers being that it's a job that demands less of a skill-set than other jobs. There is very high turnover where I work, of all kinds of people, but of all the seven black people I can remember them hiring, only one has lasted longer than a year (actually she's been there quite awhile), while the rest didn't last a year, and most didn't last six months. The neighborhood I lived in back in south Florida could've arguably been the opposite since there were more blacks, latinos and folks who were both than non-hispanic white people.
It is a natural human tendency to job-hop. A lot of people do it. However when a group is in the extreme minority, it's not hard to see why their entire group gets dragged down in reputation in the process. Is that really fair? Of course not. That's why I'm glad there are laws in place to protect people.
Yes, it happened to me, too. Went into a place in the city to get lunch to take out at one of the hot/cold salad bars. I was the only white person, three or four black people there. Behind the counter was a black guy who wouldn't look at me, just rolled his eyes and waved over the black customers to get ahead of me. Also behind the counter was some poor little Asian girl who looked completely alarmed and kept looking at me with her eyes wide. He was SHOWING ME that I was to be punished for whatever some dead white person had done to HIS ancestors. I thought about dumping my food and walking out, but then decided to just stand there and stare at him for my own amusement. I AM a six-foot-one-inch-tall white woman, so I was his height. He finally took care of all his black customers, not one of whom mentioned that I was there before them, and then he rang me up with a few grunts, still not looking at me. I smiled sweetly and said, "Thank you!" just to burn his ass, stuffed my change into my pocket and left.
And then...I walked outside and down the sidewalk, my anger at this 100% prejudiced jerk starting to grow, when a black woman walking toward me said, "Excuse me--you've got a couple of dollar bills sticking out of your pocket. Better be careful--someone might see that and take your money."
And that served to remind me that people have to be taken as individuals. Black, white, whatever--some are azzhole's, most are not.
I too see people for their character. I have had blacks take my side regarding another black person who happened to be militant and hateful.
I have always went out of my way to be extra kind to any black person because I want to assure them I am not a racist. I will not address anyone who is hateful toward me, I just ignore them. I also realize it is the parents who teach a child to love or hate. But as they get older , it is they who choose to hate or love . One must come to the time of responsibility for their choices regardless of what they have been taught.

Wanted to say that this post doesn't make much sense to me. Years ago (only 40 years ago I might add) over half of the black population in this country lived in poverty and had high rates of infant mortality and infectious diseases, and generally weren't very healthy. My great grandmother had 14 children and only 4 of them survived past the age of 4. They were miners who made a few dollars a week and lived in horrible poverty. Welfare didn't make them destitute back then so the black pastor you spoke of, doesn't know what he is talking about.
Also about kids doing drugs and liquor with too much time on their hands, this can be seen in all corners of all demographics, not just black people.
Honestly these last few posts on this thread is why I said that black people are demonized. I could give you hundreds of stories, both personal and professional (I worked at a bank both in person and via the phone in the south and some of the explicitly racists things I was called and told about by white people are very shocking) but I do not see all white people like the nuts I spoke to at work or those who lived in my neighborhood (I lived in a very integrated poor neighborhood and we had some crazy doozy redneck, PWTs - poor white trash folks who lived near us who were the most ghetto low class, disgusting people I have ever met) but it is ridiculous to say "oh those whites like to let barn animals live in their house, you know those whites are dirty, nasty, despicable people like Betty and her husband Bubba and have 8 kids and let a pig sleep in their living room" that would be ridiculous and stereotyping all white people unfairly and unnecessarily since the large majority of white people do not live like this. This description is actually about some neighbors of mine when I was younger too BTW but I knew they were just loony just like I know that extremely ghetto crazy black people are loony and the majority of us are nothing like that.
It is too bad that so many of you like to generalize whole groups of people and believe the images you see in the media as a true representation of blacks in this country and around the world. Ignorance always makes me sad.
Also I think it is crazy to go out of one's way to be kind to someone just because they are black. IMO that is a character flaw. You should be kind to people just because you are a kind person. I am not nicer to white people than I am to black people or Asians or Latinos or anything. I am just respectful to everyone and see everyone as an individual worth of respect until they prove that they are a nut and then I just ignore them and not associate with them any more.

A story in Charleston WV will never be seen in the news because it was never reported to 911. An obnoxious wall of meat similar to the youtube creep stood on line at the local grocery store speaking so loudly that no one could hear the cashiers inches away. Then he got up in my face, stepping on another to do so, and bragged about his recent 20+ yr stint in prison. He was sure to let me know he wasn't intimidated by an old white lady, which announced to all he most certainly was. If he had dared break the plane of his arm I had it all mapped out which direction I'd be throwing him.
I got up in his face and let him know that while he was in prison black kids went to school and graduated with honors despite him. That a disabled black boy down the street, who'd give his eye teeth to be able bodied, learned a trade and was doing quite well for himself. That while he was perfecting his juvenile delinquency for 20 freaking years, a black man became President. That his trashy arse intimidating the black cashier and the other black ladies on line to the point of tears was NOT acceptable.
