You forget, States have more power than our federal government does.
Until there is a constitutional amendment, the States can do as they wish, if their legislatures don't agree with some brilliant idea coming out of the White House and special interest.
This is the perfect example, that the States have no power in the federal government in DC any longer, since the days Senators were appointed, by State legislatures to be a State representative.
