Before it was born with Downs Syndrome.

"PORTLAND, Ore. - The parents of a child who has Down syndrome have been awarded $2.9 million in a lawsuit they filed against Legacy Health.

Jurors found that the hospital was negligent after doctors told Ariel and Debora Levy their unborn baby did not have Down Syndrome.
The child was born with the condition and the parents said based on what they were told, they chose to continue the pregnancy. After their child was born, the Levys said the doctors were "negligent in their performance, analysis and reporting" of test results."

Very sad.

I agree with the parents. It was negligence on the doctors part. I am for allowing abortion when the kid has something wrong with it. I would have had an abortion as well if I had known it had DS.

Wow. I wonder if a young mother I know could sue because the doctor's office gave her a result that said positive for Downs syndrome and tried to get her to go in for an amniocentesis so she could have the baby killed, but she had a perfectly "normal" child that doesn't have Downs at all.

If they push a mother toward abortion, there's never a problem for them.

If you had actually bothered to read the article you would have found out that it wasn't just about abortion but the right to know in advance and therefore prepare for the birth. Given that DS kids usually have all kinds of serious problems in addition to mental retardation such as heart conditions and very early onset Alzheimers it is not all that much of a kindness to bring a child into the world who will face a great likelihood of severe suffering. I am sick of conservative sanctimony to the contrary.

The right to know?? What right is that? How bout the right to live? These parents now have enough money to ship this unwanted child off to some home to grow up and be loved by nobody. Hitler would love what is going on around here with genetic testing deciding whether to kill a child or not. Heck they probably shoulda just gutted her when they found out and called it a post partum and be done with it.

What ever happened to abortion for rape, incest, and the health of the mother??

As far as I know they are considered disabled from birth. Makes more sense than some loon who is depressed. What is your point with this question?

Do you know anything at all about Down Syndrome? Just out of curiosity?



Special preparations should be take during birth if the condition is known about in advance. Really. This is not about conservatives patting themselves on the back for their alleged love of disabled people even though they run around cutting services for them all the time. This was about the hospital's failure to read the test properly even when there were other indications that there was something wrong.

It was that failure that probably hurt the little girl. What if she'd had a heart condition that needed immediate treatment? What if she had other problems as a result of the DS?

This is a medical case. Stop using the hospital's screw up as yet another excuse to pat yourself on the back because you're so in love with fetuses.

Oh and give it a rest with the idiotic Hitler nonsense. Hitler promoted abortions for Jews.
