How the hell does one determine if someone is gay or not? Do they wear a sticker on their forehead that says "Im gay" ?

If two guys were to get in a fight over something and one just happened to be gay...someone uses the f word(a common used word when two males fight) that turns into a hate crime? That's absurd. You have zero way of knowing if someone is gay or not.

I agree. Whether or not it ends up being a hate crime, she should be charged with something. You can't go around attacking people - no matter how much you dislike them... And it sounds like she definitely injured the guy...

She knew the guy was gay. Read the article for crying out loud. Thus the "hate crime" charge. To clarify: If you know someone is gay, assault them BECAUSE they are gay, that's a hate crime. At least in that state.

Assault is assault, if you are 18 or 80. People don't get a pass if they are old. Hitting him the throat with a cane, even at 70, can do severe damage. She was aiming to do it with the report of several strikes in the area. It is a hate crime period, she went after him because of what he was born with.

Would she get a pass as well if she decided to shoot him instead?
