Fine charge her with assualt but the hate crime charge is absurd. So what she probably called the gay guy a "f**" folks say all kinds of stuff when they are mad. Why should they face more punishment because of a word?
So if she had assaulted a straight guy and called him a "f**" should she charged with a hate crime as well?
In this crazy world of PC, some people have more rights than others.
A man would have just taken the cane away and walked away.
Calling a straight man a f** is an insult, calling a gay person a f** and assaulting him is a hate crime.
It's not PC gone mad, it's the law. The prosecutor seems to think the evidence is there to charge the lady.
It's not up to the victim, genius, it's up to the police and the prosecutor's office.
How the hell does one determine if someone is gay or not? Do they wear a sticker on their forehead that says "Im gay" ?

I agree. Whether or not it ends up being a hate crime, she should be charged with something. You can't go around attacking people - no matter how much you dislike them... And it sounds like she definitely injured the guy...

She knew the guy was gay. Read the article for crying out loud. Thus the "hate crime" charge. To clarify: If you know someone is gay, assault them BECAUSE they are gay, that's a hate crime. At least in that state.
Assault is assault, if you are 18 or 80. People don't get a pass if they are old. Hitting him the throat with a cane, even at 70, can do severe damage. She was aiming to do it with the report of several strikes in the area. It is a hate crime period, she went after him because of what he was born with.
Would she get a pass as well if she decided to shoot him instead?
