Yes but nothing he's done should amount to a felony. It's pretty petty, non-violent sort of stuff. Making hima felon will simply assure he does worse stuff in the future, when he can't get a job, vote, have a gun, etc.
I agree that calling the cops was over the top and he certainly should not be charged with a felony - but he did steal inventory. McDonald's should have let him pay for the soda by cleaning the restrooms for an hour or so.

All his previous crimes led up to his felony. At some point he personally made the decision to not care about the consequences of his actions. Whether they hurt himself or other innocent persons.

Are you saying that the gentleman in question is an innocent person - or are you making a distinction between innocent persons and guilty persons?
A Florida man was arrested and held on $6,500 bond after police in Collier County said he left a McDonald's without paying for a cup of soda valued at $1.
Mark Abaire, 52, had apparently asked staff at the Naples restaurant for a courtesy cup of water, but instead he allegedly filled the cup with soda from the soda fountain and sat outside of the restaurant, according to a story in the Naples Daily News which cited the police report of the Thursday incident.
Ah yes the old water scam. Done thousands of times by many.
Yes - and this whole needless situation could have been avoided if the McDonald's emplyee would have filled a cup with water from behind the counter and handed it to the man.
It is the same principle behind why some people, when asked by a street person for a couple dollars so that they can buy a hamburger - will instead offer to take them to a burger joint and buy them lunch. Often the street person will decline - because they intend to take the cash down to the corner liquor store and buy a fifth of Smirnoff.
Now the taxpayers of Collier County have to pay for this guys upkeep because the McDonald's managers wasn't resourceful enough to handle the situation on their own.
Has nothing to do with this incident. He purposefully committed those crimes.
