It is a weird state. Judge Judy lives in Naples, lol.

In DV cases if a spouse accuses the other of assault/abuse, and then drops the case, the state prosecutor can still step in and charge the spouse with domestic violence anyway. It is a way for the state to make money.

Justice has nothing to do with the legal system.

What this boils down to is special interest driven legislation. The man could not be charged with a felony for committing a series of misdemeanors without some bill being passed into law in Florida that allowed for such a thing to be done if a clear pattern of criminal misconduct can be demonstrated. The existance of such a law makes a mockery of the term "felony", does not address the problems this guy likely has, and fills the prisons with more bodies - which is exactly what the law enforcement and prison guards unions want.

In California - the LE and prison guards unions were behind our "Three Strikes" law which requires any two time felon, upon the conviction of their third crime - to be sentenced to life in prison. Note that the third conviction does not have to be a felony.

The law being applied in this Naples, FL case appears to be a watered down version of California's three strikes law - and it's only purpose will be to line the union leaders pockets by ensuring job security for their members.

Totalitarian societies are always created by selling the implementation of laws as beneficial to the populace - when the only benefit will come to those who wield the power.

There are no unions in Florida.

FL is like a police state, it has been happening in the past ten years, from both sides of lawmakers ( R and D) in tallahassee.

Anyone who's lived there would be aware.

Hence why I despise conservatives who should know better. Their good desire for law and order has been used against them like cattle herding instinct at the slaughter house. The "common sense conservative" is like a modern made fatty pigging out on franken fat foods thinking they can go with their senses. All such buttons can fall into misuse yet they do not suspect that the one ringing the service bell has come to rob them. What they fail to realize is they are feeding the very beast they think they hate. Does anyone think the Geo group will have an objective view on " weed". Adam Smith, a so called founder, breathlessly tried to warn them.

He is showing a pattern of criminal behavior. Most major criminals where doing little things to start and then escalated once they felt they could get away with more and more. People need to learn there are consequences to their actions.[/quote]

Major criminal start small when they are 3 or 4 years old , I'm not sure but wasn't this man in his 50's..I'm just saying!!!!

I thought it was against the TOS to post headlines that were false or misleading.

He was NOT charged with a felony BECAUSE he "stole" a $1 cup of coffee.

From the attached article

"but because Abaire has previous convictions for theft, the charge was upgraded to a felony.

Ten minutes.

[the cup of soda was $1, not minimum wage equivalent]

Correction, you can DEFEND YOURSELF and accidentally kill a teen and walk free.... but get a felony for stealing from rich folks

I do get what you are saying.... a felony for stealing a 1 $ cup is very excessive
