Why should anyone be outraged? The driver broke the law and will have to pay the price. I thought conservatives supported the rule of law - illegal is illegal and all that.

WND is a little late to the party.

It's been all over the news since it happened on April 17th.

And, yes, that's the sentence for smuggling ammunition into Mexico.

I see the Lefties think it's ok to jail someone for breaking a law in Mexico involuntarily, but it's NOT ok to jail illegals here for MULTIPLE crimes?!

I fail to see what a driver smuggling ammo into Mexico has to do with illegal immigration.

There is no dispute in this case that the driver entered Mexico with a truckload of illegal items. Do you really think that if a Mexican truck driver tried to enter the US with a load of illegal contraband, they would just let him turn around when he claimed to have missed his exit? The driver should have stopped, got out of the truck and called the US authorities. Something about the driver's story doesn't add up.

And yet, when we have Mexican citizens breaking real laws in this country, we give them a free education, health care, welfare and if we're feeling really mean...we send them home. Time for a little turnabout if they lock this guy up. Next criminal alien that breaks our border laws gets 35 years.

You can't possibly be delusional enough to equate smuggling 250k rounds of ammo with a person simply crossing the border. How many Mexicans have we already put in prison for 35 years or more that were caught smuggling drugs into the US. That is a more appropriate comparison.

By all accounts, it really is a tragic accident, but one which could have serious consequences.

I've trucked into Mexico and they really do take a VERY dim view of guns and ammunition crossing their border. Whenever I went down there, I'd leave my gun and ammo at the brokers office or, if I knew I was going there before leaving home, I just wouldn't take them. Canada is about as bad. You can easily end up in jail in either country.

However, here's the problem. Mexican law is not based upon English Common law as are ours and Canada's. It's based upon Spanish Royal law and DOES NOT INCLUDE A RIGHT TO HABEUS CORPUS. He can't be bailed out. In Mexico, you can be legally held for a VERY long time without ever being charged with anything. Mexican law DOES include the recurso de amparo, which protects citizens from unconstitutional actions by the state. If a person is believed to be illegally held, a case can be taken to federal court under the amparo de libertad provision of the Mexican Constitution. This takes time. How much time will depend upon how busy the court is. The bottom line is that the driver can end up being held for a long time while an amparo motion makes its way through the courts.

There is little the US government can do about it. We have a pretty good working relationship with the Mexican government as a whole, but no real influence over their independent judiciary. Mexico is Mexico, not the United States, and Mexican law applies once you cross that border. And, just like here, whether or not you intended to break the law makes little legal difference.

It's a shame this happened and, having driven through that area myself, I can say it certainly is possible to end up on that bridge going over the river. I can also say that what's happening to this guy is entirely predictable.

Bottom line? In the end, I believe he will be released, but probably not his truck and cargo.

(Given that it is Mexico, there's always the chance that he hasn't been released yet because nobody has paid the mordida necessary to spring him. Mordida in Spanish means "the bite" and it's basically a bribe. It's how business is conducted in Mexico (ask Walmart). Not much gets done without mordida being paid.)

Absolutely not. In one case, we had a person working for a living that made a simple traffic error. In the other, we have people deliberately breaking the law. No comparison at all.

Please, search through my post history and point out where I have ever claimed this.

If someone legitly breaks a crime, they should do the time allotted as the law calls for.

No matter who, no matter what, no matter where.
