Is our judge this low and lack of common sense?

Could the Woman Who Sent a Text Message Be Held Accountable for Causing Driver to Crash? Judge Napolitano Weighs In | Fox News Insider

What's next? I should able to sue Home Depot for selling me the hammer that I intentionally slammed on my hand?

This is the age of zero responsibility.

Pathetic!

That is a little crazy. Just because you get a text doesn't mean that you have to read it now. When I am driving I don't talk or text. If I get a text I will wait until I am no longer driving as with calls.

How was the sender supposed to
know that the recipient was driving?
Does it get any stupider than this?

Exactly. One isn't forced to read the text at that particular moment while driving, either.

What has personal responsibility go?

No government wants to regulate what we eat because some people choose to be fat and obese. Yes, it is a choice. Just look at the Biggest Losers Show and see how a choice can change a person life forever.

See...that is what people don't understand about the stupid way our tort system is.

You can sue anyone for anything. I can literally sue you all right now because of the font you chose for your responses.
It does not have to make any sense. Does not mean I will win...or even get far with the case. But how much money is it gonna cost you to defend this?

No, it is the responsibility of a driver to not get drunk, text, talk on the phone and many other things.

Sheesh get an iphone. They read your messages to you, hand free, and can even write responses, again, hands free. I am sure most iphones have something similar.

No reason to be texting and driving anymore.
