President Obama and Congress levied this tax. They refused to CALL it a tax when they were campaigning for it's passage in Congress, because they were still selling the pablum of not raising taxes. Of course, as soon as it got to the courts, the lawyers argued that the "penalty" is allowed by virtue of Congress power to tax. Can't have it both ways. It IS a tax, even if President Obama & his lackeys in congress don't want to use that word.

The Affordable heath care act must now move forward and change the awful present health care system in the USA forever. As far as Businesses and work related health care is concerned and health care competition.... this health law being upheld will go a long towards lowering premiums, increasing health cover, improving health standards, helping business owners by eventually taking health care out of the work place and not being part of our salaries. Big business can concentrate on profits, production and companies paying fair salaries and NOT paying low salaries to afford the current health system in the USA. The only competition that will bring down private health premiums is a eventual UHC.... this has been shown to reduce premiums significantly and increase competition and benefits..... this isn't just a idea but a working actual fact..... UHC's bring down costs, not only medical costs but pharmaceutical costs and covers EVERY AMERICAN!
Kudos President Obama for starting to build a REAL American health system.......

I love how the right is saying that this ia a tax on the middle class. Far fromm the truth as usual. It is only a tax on those who do not have their own health care from work or other sources and who refuse to buy into the government health care. So someone from the right, please explain how this is a tax for the middle class?

Let me just say this straight out:

This being a new tax does not reflect negatively on Obama at all. He did not intend for it to be a tax, it's not on him that it got changed to be so. It's on the Supreme Court.

However, this rewarding the healthcare industry and not doing anything to fix what is broken does reflect somewhat negatively on Obama, since he threw his support into it, even though it's not even what he originally went for.

Insurers cannot discriminate against people with pre-existing conditions?

That's like buying a wrecked car, getting full coverage insurance, and then demanding the insurance company pay to fix the car.
