The White house tells the court it's not a PENALTY, so the Commerce clause doesn't apply. Well, the ONLY way that can be true, is if it's a tax, so the Supreme court lets stand Obamacare under the guise that the penalty is actually a TAX.
First it was a penalty. Then it was a tax. Now it's a penalty again.
The war of words over what to call the fine attached to the federal health care overhaul's most controversial provision continued Friday, as the White House took issue with the Supreme Court's argument -- even though that argument alone spared President Obama's law.
The five-justice majority argued that, while the fine imposed by the law for not buying health insurance would otherwise be unconstitutional, the fine is actually legal under Congress' authority to tax.
Ergo, the fine is officially a "tax" in the eyes of the court. The law stands
It wasnt a tax to begin with. Obama's lawyer even bringing that up should have resulted in it being tossed out during oral arguments. And no way should Roberts been allowed to change the wording of the law, because it was NOT written as a tax.

And don't count on Romney repealing this. Did Obama repeal the Patriot Act ? Did he let those parts expire when they were supposed to ?
US citizens are "consumers" to the corporate world and "taxpayers" to the government. You are a source of revenue for them. The more you make, the more you will give away to them. How much do you end up keeping for yourself for the future (retirement, savings) ? I'd say very little these days from what I read.
How is something a tax if only 2% percent of the population will be effected by it? And, they don't have to be effected by it, it's their choice. As I continue to state, if I choose to park in a handicap sopt and get a ticket, that's a penalty not a tax.

Well, those 2% must not have a lot of money because they lowered the penalty to make it "affordable".
That's who it will really hit. Most have insurance but just high premiums. They will keep their insurance because the government will now subsidize them for a substantial portion of it.

It IS a tax. Period. If it is not, then it is unconstitutional according to the recent decision. Obamas lawyer made a case for it to be a tax and that is why it was upheld. Now the liar in chief wants to put words in the mouths of the justices to serve his own purposes and keep the truth from the American people once again. Unbelievable!
Wrong! Blame obummer and his crooked cronies as they are the ones whom created the disastrous health care tax.
