The citizen is lucky that he and his pets are still alive. As far as the steroid abusing jack booted thugs that comprise today's police forces are concerned contempt of cop is a capital crime. Executions are carried out on the spot without need for those pesky rights to due process. Just like the Gestapo, police officers in the US know that they can get away with any level of abuse up to and including murder. The worst punishment a dirty cop might face is a lengthy paid vacation.

if you are inside your house probably no summons would be issued. but if you come out on the lawn and yell and scream, they will get you for something.
the charges may be off but what u r doing also is off.

"to which the public or a substantial group of persons has access, including, but not limited to," a park, sidewalk or beach.

Well, I got busted for this at the board walk too. Was I torqued? You bet but the law says you cannot drink on an area like a sidewalk or public area. I learned the expensive way and will never make that mistake again. A guy got busted for "leaning" against the boardwalk wall so if you are in any way "touching" a public area you are gonna get busted. This includes sidewalks, alleys, walls built by the City, etc.

The sooner people realize we are no longer citizens but subjects and we have no rights unless we make them give us our rights back the better off things will be.
YES 100% ! and we all need to start demanding a verified complaint on all of these type of tickets, That is one of our rights , hoqw was he injured by you drinking on your "PRIVATE PROPERTY" . That just goes to show hoew stupid some people get when you put that heave badge of their shirts , it pulls their brain ( if they even had one ) down to their arse, where they can see any rights only wrongs.

But Steven Banks, the chief lawyer for the Legal Aid Society, said that in Mr. Rausa’s case the open-container law should not have extended to the stoop because it was private property.
This atty is incorrect because he left out the word within, which means inside out of public view or free pulic access.

The open-container law includes being in public view. So it doesn't matter if he was on his private property. It would have been fine if he were in his rear yard as it is not in public view. This law has been in effect for nemerous decades.

Quote:
The city’s open-container law prohibits anyone from drinking an alcoholic beverage, or possessing and intending to drink from an open container containing an alcoholic beverage, “in any public place.” The law defines a public place as one “to which the public or a substantial group of persons has access, including, but not limited to,” a sidewalk, street or park.

The way public places are defined in law is not constrained by whether the place is privately owned. Texas, for example, defines a public place as any place where the public or substantial group of the public has access. That means your porch can be defined as a public place unless you have implemented some substantial means to limit the general public from being able to walk up to it and enter it.
