Jim Garrison: Martial Law by Executive Order

I heard about this last night. I guess this was one of those things that kind of just happened in the middle of the night. I dont recall being aware of this before, but perhaps I was and just forgot.

What the hell is this about? As far as I know, the writer of this, is a liberal. Not as if he is some far right guy. Why wasnt this made a big deal of? Does anyone recall ever hearing about this on the news?

Quote:
President Obama's National Defense Resources Preparedness Executive Order of March 16 does to the country as a whole what the 2012 National Defense Authorization Act did to the Constitution in particular -- completely eviscerates any due process or judicial oversight for any action by the Government deemed in the interest of "national security." Like the NDAA, the new Executive Order puts the government completely above the law, which, in a democracy, is never supposed to happen. The United States is essentially now under martial law without the exigencies of a national emergency.
Quote:
In the NDAA, only the president had the authority to abrogate legitimate freedoms of U.S. citizens. What is extraordinary in the new Executive Order is that this supreme power is designated through the president to the secretaries that run the Government itself:
• The Secretary of Defense has power over all water resources;
• The Secretary of Commerce has power over all material services and facilities, including construction materials;
• The Secretary of Transportation has power over all forms of civilian transportation;
• The Secretary of Agriculture has power over food resources and facilities, livestock plant health resources, and the domestic distribution of farm equipment;
• The Secretary of Health and Human Services has power over all health resources;
• The Secretary of Energy has power over all forms of energy.
The Executive Order even stipulates that in the event of conflict between the secretaries in using these powers, the president will determine the resolution through his national security team.

This is pretty frightening stuff. This really gives the President and his secretaries, a vast amount of power, disregarding previous rules of law.

Why should we not be concerned with this? How is such a thing, Constitutional?

We should be concerned about this. We should be concerned about anything that gives anyone the right to abrogate our freedoms. However, we live in a world where people are more concerned about birth certificates, college transcripts, tax records, and personal wealth portfolios than they are about what the president is actually doing or what the next president might do. Welcome to America, that used to be the home of the free and is now soon to be the largest third world nation in existence.

Yes, I have heard it before from every administration I can remember. Bush had several such executive orders, and Clinton had his. They were called continuity plans.

It is probably what a catastrophic event would call for temporarily.

Chilling indeed. Sounds like something straight out of the former Soviet Unions playbook! We really need to wake up and vote out these big government politicians that do not represent the best interests of ALL Americans!

And how exactly would Obama actually implement and enforce marshall law? The military is spread too thin as it is, plus they take oaths to protect and defend the Constitution, not the president. Hence, this would be an unlawful order that they wouldn't obey.

I dont think it is right, or Constitutional, to use an emergency to gain this type of power. And it sounds like they can avoid Congress and just do it.

This was something signed this year. I think we deserve an explanation on this, and the fact that I dont recall hearing anyone from DC talking about this, I find troubling.

I cant fathom, how we as a people, should view this as a good thing.

Catastrophic event, is supposed to lead to basically a police state? Do you forget what country this is? United States of America. How can you defend this? Where does it say that this is only for catastrophic events anyways
