Actually, truth be told, a picture of a topless female teacher should be treated no differently from a topless picture of a male teacher. Laws should apply equally to men and women in this society- there should be no unfairness or double standard. It took America a long time just to drop the double standard of women not being allowed to vote. Each bit of progress America has made in women's rights has been obtained bit by bit, one item at a time, and each time battling opposition which clings to old fashioned views of how women SHOULD get lesser freedoms and rights than men. This is no different. This female teacher and her topless photo should be treated the same way as if it had been a male teacher and his topless photo. America should offer equal protections under the law. If a male teacher would not be fired for this, then it was right not to fire this female teacher either.
Unequal/inequitable application of the law (of rules)and of freedoms and rights is a HUGE pet peeve of mine. America needs to systematically eliminate double standards. The outcome of this incident is a step in favor of eliminating double standards for women vs men.
The teacher was careless, true. But that doesn't change anything about the analysis of what the kids did or did not do once they found the photo.
Same way they know better not to pass around a naked photo that they brought from home and know better not to pass around naked internet photos. These are 13 year old kids. They know you don't pass around sexual materials in school, no matter how they got their hands on the material.
I believe this is a false argument because that specific is more than covered in the general admonishments of not passing around ANY sexual materials at school, just like not handling any drugs, etc. In today's internet-driven society, parents are talking to kids about what is and isn't acceptable computer behavior, and schools are as well. 13 year old kids know you don't pass around naked photos no matter who they are of and how they were obtained. Heck, kids can even be arrested for child pornography if a 13 year old passes around a naked picture of another 13 year old. Between parents and the school, these kids know full well they aren't supposed to pass around naked pictures. So when a naked photo of a teacher happens to find its way into the school, they know they are not supposed to pass it around. And again, what they did once they found the photo has been left out of the story, but it stands to reason that they DID pass it around and that was the cause of the suspension, not that they happened to push one button on the main screen, see a naked pic pop up, and then take the iPad to the teacher or principal.
I don't have kids, And missed this factor you describe above actually. it's a good point you raise OP. Still has no place in a school given the stir it will cause alone, In regards to the teacher.
Reminds me of how difficult it is raising kids in today's world.
Exactly what's wrong with this country. Idiotic parents running interference for their misbehaving kids. Unless she handed them the Ipad to play with they were messing with something that did not belong to them. Why is this difficult for the mom to comprehend?

The school has now released a press release and their version of what happened and it makes a lot more sense. According to them there was no topless, naked or pornographic picture at all. The issue was that the boys were to use the IPad for school work, working only with two applications on the IPad. Instead they went searching the teacher's IPad and went into a folder called IPhotos where they looked at pictures of the teacher. That's what they were suspended for, not for seeing the teacher topless which she apparently wasn't.

"On Monday,October 15, 2012, there was an event at Highland Middle School in which students viewed a picture of a teacher on the teacher’s school-owned IPad.
While Federal and State law prohibit the School Corporation from disclosing precise information as to the identities and any actions the School Corporation undertook in connection with students and personnel, the School Corporation feels a need to clarify, as best the School Corporation legally can, the events. The School Corporation feels a need since there has been numerous versions of what occurred on Monday.
A teacher gave certain students access to a school-owned IPad, which had been assigned to her, for a precise purpose of working within two (2) different applications. The students explored the IPad and went to unauthorized applications, one of which was IPhotos. Unbeknownst to the teacher, a picture which was on the teacher’s personal cellphone had been stored in ICloud and therefore streamed to her school-owned IPad. That picture was not a topless picture, not a nude picture, nor any pornographic material. The Anderson Police Department has investigated the issue and concluded that the picture was not pornographic and there was no criminal behavior. IPads are new for teachers this year and were provided for enhanced delivery of instruction.
Following the events that occurred Monday, the School Corporation will establish stricter protocols in connection with students having access to school-owned computers and the connectability of those devices to personally-owned compatible Apple products."

Well that certainly changes the entire story. But why were the boys suspended ?
If the school wants restricted apps for teachers only then it's up to the school to make sure the students can't open certain apps. The boys should not be punished at all here.

Wrong, they were punsihed for doing what they were not supposed to do. if you went surfing on your wor computer and found a topless picture, don't you think your work would punish you?
