Looks like the California ban will be struck down too
Thats a completely different argument, and reading the ruling, you couldnt possibly come to that conclusion.
The Supreme Court repeatedly calls for state rights to define marriage as they wish, just that the federal government must recognize it..
It may or may not go down on a state level.. I'd be shocked if it doesnt get banned on a state level by the Supreme Court, but you cant possibly conclude it will based upon this reading.
btw, its not the 3rd thread on the topic at least.
not really.. If you read the ruling, it puts a lot of emphasis on state rights, and even if you object to gay marriage, returning power back to the states should be applauded.
Interesting. The majority decision supports states' rights and forces the federal gov't to refund $300k+ in tax revenue, which coincidentally the Obama admin tried to hold onto even though they didn't want to enforce the provision in DOMA that allowed them to do so.
Are we sure this came from the liberal wing of the court?
From the opinion:
Although “the President . . . instructed the Department not to defend the statute in Windsor” he also decided “that Section 3 will continue to be enforced by the Executive Branch” and that the United States had an “interest in providing Congress a full and fair opportunity to participate in the litigation of those cases.” The stated rationale for this dual-track procedure (determination of unconstitutionality coupled with ongoing enforcement) was to “recognize the judiciary as the final arbiter of the constitutional claims raised.” Id., at 192.
What is DOMA? One of the first things I learned in accounting class is to identify the subject. It does not matter the dollar amount beside the subject if you don't know what the subject is. Spell it out!
