I'm going to preface this by stating the Second Amendment guarantees our right to firearms and the courts have repeatedly reaffirmed this right. This right is not set in stone. To stop this endless debate and the inevitable endless court cases that are going to happen over any new legislation what I propose is that those in Congress that support new gun control legislation put together a proposal for either repeal or modification of the Second Amendment. This is clearly the correct course of action as it will not be an attempt to try and skirt the Second Amendment, it will prevent endless litigation and most importantly it will end this debate once and for all over interpretation of the Second Amendment.

Default Repeal or modify the 2nd Amendment

Please tell us what changes you would like to see in this document?

Should firearms ownership be restricted to citizens?
Should it be limited to the financially responsible?
Should violent criminals and the certified irresponsibly insane not be allowed to have guns or other weapons?
Should it be limited to people that require guns for their jobs as police of private security?
Should it be limited to hunters only during their hunting or range activities?
Should it be limited to only military during active patrol or on base?

IMHO firearms ownership and carrying anywhere they have a right to be should be available to all citizens that have not been convicted of a violent crime or found to be irresponsibly insane.

How about we enforce the hundreds if not thousands of laws already out there?

You really don't know what it takes to pass an amendment to the constitution, do you? Go back to school and come back when you have a decent understanding of how our government works. Till then, keep your fantasies to yourself.

Greg, any proposal would fail miserably so your question is a moot point.

Yes I'm quite aware of what it takes to amend the constitution.

A clear case of not seeing the forest through the trees.

So you really think the state legislators in places like Pennsylvania, the Dakota's, Montana, Wyoming, Iowa, Texas, and just about ever other state outside of the coasts are going to pass such an amendment? See, this is what people like you really don't understand. Obama might have gotten re-elected, but that was based on a national stage were large, liberal states can dramatically sway the vote. A constitutional amendment requires a state-by-state vote. California has no more weight than Wyoming. As the election showed, the majority of the states are not on Obama's side. This is what the founding fathers intended and thank god for their ideals. If anything we should repeal the 17th amendment and return the power of the Senate to where it belong, to the states.

BTW, this is from the PA constitution. Is this also only for a Militia?

Section 21 . Right to Bear Arms
The right of the citizens to bear arms in defense of themselves and the State shall not be questioned.
