No, they don't. Any law restricting the 2nd Amendment right to keep and bear arms is un-constitutional whether you anti-gun people like it or not.

Glad to see you are proposing impeaching someone besides Obama, impeachment proceedings are wearing thin, you don't like Cuomo or the senators that put in sensible gun legislation, then don't reelect them.

IMO, NY SAFE have some good parts and some bad parts.

Good parts being Universal Bkrnd checks and stiffer penalties for trying to get around one.


The Bad:

Everything else. I mean seriously, do they really think a magazine that holds 3 rounds less than the current limit will help.

This makes the M1-Garand illegal also and the vast majority of semi-automatic handguns currently on the market.

Also, I'm rather displeased with the banning of online ammo sales.


I'd rather see gun laws formulated around this.

Regarding private sales, enact strict(er) liability, i.e., you as a seller must take reasonable steps to make sure the buyer is not a criminal, on the blacklist etc. (Which is what this law did)

Obviously, allow private gun owners to the Federal Database that is currently available only to Gun Stores to allow the "above" suggestion to work. (which apparently this law also allows and restrict gun stores to provide reasonable pricing for private sellers to access the Federal Database, something like no more than 20 bucks?)

The current ATF regulation of fully automatic weapons should stay in place.

DON'T reinstate the assault weapons ban, its just stupid and only bans "scary" looking weapons.
If you're look to reduce accidental gun deaths, require basic safety classes as a prerequisite to getting a gun license/permits.

Also, require permits for firearms ownership (common sense restrictions, relatively reasonable ease of acquisition), so at least criminals will have a hard time getting legal guns, but law - abiding owners still have access to equal the playing field.

I'm on the fence regarding CCW.

Also, affirmative proof of mental health/sanity (like Japan, go to a psychiatrist or mental health professional and get a clean bill of health before going to apply for your permit).

Point is, the less "legal" guns used in crimes, the better. Less blowback for people who want to be responsible gun owners.

You would think that those so well versed in their Constitutional rights would also understand that laws in violation of the Constitution are dealt with through the Supreme Court and the "activist judges" within. The federal government cannot impeach a state official and it is rather unlikely that the NY state legislature would vote to impeach the Governor over a signing piece of legislation that they themselves passed! All that is putting aside the fact that there is nothing impeachable about signing duly passed legislation or that impeaching the governor would do nothing to undo the legislation.

Yes it clearly is. It just has not been sent to the Supreme Court yet. It is a new un-constitutional law and there is a process that must be initiated and played out.
