Apparently that's the issue--the timing of the vacancy and whether the recess was a recess as defined by the Recess Appointments Clause. Sounds quirky--here's the full opinion for everyone to read.

No, that's the entire discussion, they were not adjourned....they were not in recess....which is exactly why the court made their decision.

NPR didn't rule on anything, Poindexter. A court did.
