Let's say the baker is black. The gay guy (customer) hates black people. So he discriminates against this baker and goes to the white baker down the street. No law is violated. If the gay guy decided to purchase a cake from the black guy and was refused the black guy is "guilty" of a crime.

Different situation - different ethic. One is a private person making a private decision, the other is a person engaging in regulated, public commerce.

Laws against racial discrimination are not "stupid" because people are born into whatever race they are. Many people believe people are not born gay, and criminalizing discrimination in the absence of conclusive scientific proof is a political determination which lacks the moral legitimacy of prohibiting discrimination on the basis of race, color, gender, or national origin.

Whether you are "born" that way is perhaps debatable, but it's basically accepted scientific fact at this point that sexual orientation is an unchosen, biological characteristic rather than some sort of choice.
Not to mention our anti-discrimination laws do cover one aspect of a person that is 100%, unequivocally a choice - religion.

This is a good example of why many Muslims believe the West is "wrong" and Islam is "right". In Islam, religion is not something to be left outside of business in a separate compartment of one's life.
