Lost in the comprehensive immigration reform debate is the plan to greatly increase LEGAL IMMIGRATION so companies can bring in people from all over the world in almost unlimied numbers to fill their jobs in America with the best talent that the world has to offer.

This idea sounds great in theory. Businesses will prosper if they can get the most qualified candidates and employees. But under some of the plans floating around Congress a business can advertise their job openings to an international audience, use technology such as Skype to interview candidates and then bring someone from lets say India to fill the opening, and never even consider an American.

The new Indian employee would come under a special VISA and the company could pay them less and work them harder. The company would own them.

This is a significant expansion from the H1 Visa who are mostly foreign workers who are already here or are in college, but under this plan most professional job openings could and would be filled by people from overseas under the idea that we need foreign talent. Any type of job- Accountant, Office Manager, Librarian, Nurse, Teacher, or even blue collar jobs like a Plummer, Electrician or Auto Mechanic.

I hate to tell you this but they are, this is the 'net age and anyone can look up jobs at a variety of websites and any company website for work.

Yes they can apply but currently they just can't just move to America and start working. But under the new plan basically all US job openings would be open to an international audience and if the best candidate in the employers eyes were from overseas they would not have any trouble bringing them into America to work here. It would be as easy as hiring someone who lived in the next state.

I've heard getting the government implemented rules and regulations out of the way is great for businesses that would benefit from it, and also promotes free market. All these rules that make things difficult to businesses, to get cheaper labor without having to jump over hoops and bureaucracy is not good for America.

you're talking about two different issues.

allowing high-skilled foreigners to become full american citizens and compete for american jobs is a good thing. this is something we should strongly encourage; it makes our country stronger.

allowing foreigners (skilled or not) to apply for these "H1B Visas" (or other similar programs), where they get shipped back home if they get fired, are very, very, very, very bad things. They undermine the labor market by creating a special "class" of workers that have little-to-no negotiating power with their employer. It drives down wages by having American workers compete against (basically) indentured servants.

Yep. There is no such thing as an "American job". It's a made up term. Some jobs are located in America. But the American worker does not own them. The fact that the same job can be moved to another country proves this.

And employers should hire who they think can best do the job. Period. They should feel no obligation to hire an American over soemone else if they think the someone else is abetter fit.

right, but the question is whether or not U.S. companies should be given the privilege of offering a "special" visa that the company can revoke, rather than the government.

this makes their 'right' to work in the united states a decision of their employer, which IMO totally screws up the labor market for the rest of us.

OK, let me expand the question to further clarify what I am talking about.

This is a true story:

A contract at a place I used to work at needed a 100 people to stand at a copy machine for a year to reproduce hundreds of thousands of documents. Because the job is unskilled and nearly everyone can do it, they decide to pay $8.00 an hour. But because the job is incredibly boring and low paid the quality of the workers you get here in America is not so great. There is lots of goofing off and fighting and lots of turnover and office politics. (most of the workers were welfare to work types and African American.) They had little success getting anyone else to apply.

The supervisors at this reprographics project were at wits end trying to manage a workforce that is nothing but trouble. There is plenty of potential applicants for these $8 an hour jobs in America but many of the workers are poor and productivity is low.

The managers all got together and said they wish they could continue to do the work in America but could bring in a whole new group of workers from overseas on a VISA. Maybe from India. These people (from India) would likely work harder and not cause the employee relations hassles the mostly Black workers doing the job would cause. They looked into firing the whole team and bringing in foreign workers. They determined under current rules, that is not so easy so they continue to struggle with the American born unmotivated employees.

BUT under the new proposed immigration rules they could fire the whole team and ship in hundreds of short term guess workers under a special VISA to do the job.

Should this be allowed? Would America be a better place if they could fire the unmotivated American born workers on this project, (and similar ones) and ship in Indian Guest Workers? Would the threat that many jobs currently being held by American born or legal immigrants would be offered to guest workers or special VISA foreigners motivate the current workforce or just increase our underclass and lower wages.
