These points from the news article caught my eye...

''According to Raw Story, Dugan had refused to admit as evidence the video in which Josey can be seen striking Guzman. Dugan claimed the clip was not an accurate portrayal of the situation.

This is not a social-media contest; this is not a trial by video," Dugan said in court.

How many people are accused, arrested, go to trial and serve time due to what is seen on video? How about all of those video shots of the Boston Marathon bombing? The cops sure did pick those two guys out quick and were in a hurry to arrest them for what could be classified as ''not an accurate portrayal of the situation'. How many people are identified as suspects in robberies of any kind by video? The barn door was opened by this very stupid judge who should have recused himself. He should be disciplined as well as the offending officer.

This court decision can be referred to any time a video is introduced as evidence. As Judge Dugan himself said ''This is not a social-media contest; this is not a trial by video". If this were true Rodney King would never have been heard of.

Everyday in America, judges from traffic court to the Supreme Court requse themselfs from hearing cases, not because the know they would be bias, but because they want to remove an indication of bias.

More importantly, the decission does not stop in that court and with that judge. Our judicial system is replete with oversight.
A heavily repeated axiom of law, for officers of the court, is that the appearance of wrongdoing is worse than any actual wrongdoing.

We live in a culture where reality plays second fiddle to appearances.

It probably goes back to the fig leaf.

Look, this isn't how it looks - I can explain.

stop paying the taxes or force out the corrupt politicians then fire the enforcers.

please remember that the enforcers do not even have to answer your desperate 911 call.

The inadmissible evidence because it doesn't "show the what really happened" like the guy 10' behind MS Guzman throwing the water or that Josey threw an open handed right that didn't come close to reaching for her water bottle. Hell Stevie Wonder could see this for exactly what it was.

By the way, on the strength of the inadmissible video, Police Commissioner Charles Ramsey fired Josey, didn't suspend him, FIRED his butt.

I am glad the cop got fired. now if we can get more cops fired for brutality, things might get better.

Lol listen to yourself. If she threw the beverage at him, how would he then be able to knock it out of her hand? Wouldn't it have already been out of her hand (after being thrown at him) at that point? You people have to use common sense here.

Plus, you also need to watch the video. She wasn't the one who threw the can. It was someone else who did and he mistakenly believed it was her and slapped her for it. His back was turned at the time so he didn't see the actual culprit. He was wrong either way. If you can't be a professional, ever under stressful or difficult situations, then you don't need to be a cop.
