Self defense has nothing to do with blacks or gays. All of which certainly deserve the right to self defense and the protection of their property. The sickness or missthinking found in this area is just that. Wrong thinking. The police should praise this individual for protecting his home from a burglar.

You live in Texas though and have the castle doctrine. Had he shot this burglar he could be on trial for murder.

I think everyone has the right to defend their home. With a gun if they choose.

With a legally purchased gun.

The guy had a firearm in his home? For protection from criminals?

My god, did he not have a pen?

Did he or did he not break the law?

The question isn't "Did he or did he not break the law?" It is "Do you or do you not think?" Even if you break the law you are not required to be charged with doing it. "Did he or did he not break the law?" is brainless. That's why prosecutors have discretion in what charges, if any, they will bring against someone. So the question is not "Did he or did he not break the law?", it is "Should he be charged with breaking the law?" It wasn't his gun. It was a legally registered firearm. He didn't fire it. There's no dispute he was being burglarized. A reasonable person would conclude from the situation that there's no reason to press firearm charges against this man. You tell him that if he wants to keep a gun in his house he needs to get his own and not keep his bodyguard's gun in his house and you drop the matter.

The gun was legally owned by his bodyguard and I guess the question becomes can the gun be left at the residence legally.

Let's put this into another context, suppose I leave my car at your property and you don't have a license to drive. That's not an illegal act. Now lets suppose there is an emergency and you drive someone to the hospital in that car. Should you be cited fro driving without a license?

Don't be so sure about that...we're talking NYC. Home of the largest sheep herd in the country, they seem to want to ensure that no criminals are hurt during their workday.
