How exactly would the state have known this 34 year old librarian had a script for an anti-depressant?

All prescriptions written in the state of New York, are copied to the state itself. I don't know why. I also don't know what the laws in NY are, regarding privacy of those copies in possession of the state. Is it legal for NY state police to access those prescription records, for the purpose of deciding who can and can't be allowed to own guns?

The guy in New York whose pistol permit was yanked because he had a prescription to anti-anxiety medicine, has retained a lawyer to pursure the case, a lawyer who specializes in gun-rights cases.

The case is new, and has barely gotten started. The matter is being followed closely in New York. Here are two forum threads that deal with it, which frequently get posts from the law firm handling it:

But they aren't going to take your guns, don't worry about registering them and being out on a list as a gun owners.

But was the mistake, that they revoked a law-abiding citizen's pistol permit because he had a prescription for anti-anxiety meds?

Nope. The mistake was that they revoked THE WRONG law-abiding citizen's permit because he had a prescription for anti-anxiety meds!

And what is the State's greatest concern now? Are they appalled that they restricted the rights of an innocent man?

Naw. They are simply embarrassed because they "all look foolish".

Sigh.

Oops! New York State Police Admit to Major Mistake in Gun Confiscation Case

In a surprising turnaround, New York State Police have admitted that they made a mistake when they confiscated the guns and suspended the permit of an Erie County resident on the grounds of mental health.

Late Wednesday, Erie County, NY, released a statement (see link) blaming the New York State Police for giving them bad information regarding the suspension of a pistol permit and demand to surrender firearms sent to Amherst resident David Lewis.

(Mr. Lewis was not identified in our original story, his name has since been released in conjunction with court documents filed by his attorney, Jim Tresmond.)

“Erie County Clerk Chris Jacobs said that late today he received a call from the New York State Police informing him that they had provided information on the wrong person when they notified his office of someone whose permit should be suspended because of the new mental health provisions in New York’s SAFE Act,” the release begins.

“When the State Police called to tell us they made a mistake and had the wrong person … it become clear that the state did not do their job here and now we all look foolish,” the release went on to say in a quote from Clerk Jacobs.

Jacobs appeared on WBEN radio in Buffalo on Thursday morning and explained the details of this administrative debacle. Mr. Jacobs also delivered some pointed comments about how the law was written so badly that mistakes like this were bound to happen. He closed with some fairly damning statements and also asked the state to consider scrapping the bill and re-writing it.

“When you write a piece of legislation in a vacuum, without having hearings, without talking to people about how it’s going to implemented in the real world — without jeopardizing people’s rights, and putting an individual like this through a nightmarish experience, and infringe on their rights, you have to go back to the drawing board,” he said. “And I encourage the legislative leadership here and mostly our governor to take a step back and say ‘we didn’t get it right’ and let’s change this.”

After the press release was issued by the state, TheBlaze spoke with one of Mr. Lewis’ attorney, Max Tresmond.

“We won round one,” he said, “round two will be a suit against the state for what they did to our client and his reputation.”

I wouldn't live in a state that made you get a permit to own a gun anyway. Its rediculous that one would need permission to buy and own a handgun.

This amusing excuse by the police, merely gets the present case (and its lawyer) out of the police's hair. The client is now getting his permit back, to there is no case any more.

But the police still think the POLICY is just fine: It's perfectly reasonable to revoke someone's pistol permit simply because he has a prescription for Zoloft. They just have to get the right address on the envelope next time.

As I said, this is far from over.

"The problem isn't guns! It's how we deal with mental health and depression in this country!!11!"
State deals with mental or depression.
"Oh my God! They just took that guy's guns away because they thought he might have a mental health issue!"
Which way do people want it?

But you will live in a state where you have to register your car, but not one where you might have to register a deadly weapon. OK...good. Go somewhere else.
