You don't have to worry. He will be tried on Federal Charges that do carry a death penalty.

Also he killed a citizen of the Peoples Republic of China, so if Beijing wants to lay murder charges on him I have no problems with sending him to Beijing or Shenyang to answer charges in the Peoples Courts of China.
