However, on top of that looks like the DOJ, NSA et al. Has their own little monitoring program going on giving ISPs immunity.

They have already been doing that. Not highest bidder just flat fees. DMV's do it. All kind of agencies do it. Verizon, etc...

No. They can afford good encryption. Nobody is going to spy on anything business does not want seen.
