Very sad and my thoughts go out to the family of the victim.
I was just wondering what kind of parents this kid has, that he has so little respect for rules or authority. Their punishment will be paying for his defense.

just to help me understand....

should he get less time because he punched the guy than he would have if he had pulled out a gun and shot the guy?

sadly this is true. it depends though on what he told others before he committed the deed. if he told people that he was going to kill the ref, then he might get convicted of second degree murder. its a long shot though at best.

it all depends on intent. if you get into a fight with someone, and you end up killing them as a result of the fight, and you intended to kill them, then you can be convicted of second degree murder. if on the other hand you only intended to rough them up a bit, the manslaughter is a proper charge against you.

What if the ref said mean things to him? That defense just might work for Jodi Arias - putting the victim on trial.
