Common sense terms are that a cut down adult sized lung would work better than a non-existent child sized lung, which was the actual situation.

The cystic fibrosis that destroyed her lungs isn't going anywhere. It's destroyed her lungs, and it will destroy any transplanted lungs.
Look. her doctors want to help this girl.. ask them why. I give them credence . They are the ones who know more.

But the ruling immediately raises concerns about fairness -- and the risk of more lawsuits, said Art Caplan, director of the division of medical ethics at NYU Langone Medical Center. While it's admirable that Baylson chose to try to help Sarah and others, the decision threatens the integrity of the nation's existing organ allocation process, he said.
"It is not clear why everyone now waiting at the bottom of any transplant list would not seek relief in federal court," Caplan said. "Unless the judge has reason to think the lung distribution rules are simply a product of age discrimination and nothing more -- which seems highly unlikely -- then this becomes a troubling instance of non-doctors deciding who is the best candidate to receive a lung or other scarce medical resource."

No. There are not enough lungs to go around which is why we are having this debate.

There are currently over 1,700 people awaiting a lung transplant.

Since you are so defending the judge's ruling then why don't you know ?
What differs her from everyone else on that adult list that she should get bumped to #1 spot ?

NO, just because some doctors said that an adult lung transplant will help this girl survive longer doesn't mean that the doctors think that she will live a long and full life if she gets a lung transplant. It doesn't mean that the doctors think she needs the lung more than the other people on the waiting list.

The doctors are only saying that they can modify an adult lung to fit into a child's chest cavity, and that if the transplant is successful, the child's condition will improve. For a while. Until the cystic fibrosis ruins the new lung.

Who says? I doubt it.. depends how many adults die.. and there could be more people donating their organs as a result to this story and save more lives than you could fathom.

But the uncut lung could go into an adult, which would be a better fit.

So just let her die.. is that your call? She is going to die anyway... we are all going to die sooner or later. One never knows what will happen to any of us.. I say this girl enjoys life and let her live.

And there are other children - who also need lungs. Two more have stepped up and filed suit.

Do we really want the judicial system deciding on who lives and who dies?

Really, I wish such choices didn't have to be made. I wish more people were donors. I wish there were enough organs for every ill man, woman, and child to be made whole.

But that is not the reality. Someone must decide. And I would rather it be a medical person - with a clear set of objective criteria ~ than someone who has an expensive attorney.

I do NOT blame these parents for being their child's advocate; they were doing their job as parents. BUT - it's a Pandora's box.
