The doctors had to submit a request to get the judge to move. That is obvious.
No, the parents submitted a request to the judge. The doctors simply said that (1) a transplant of an adult to a child of a lung, as long as the lung is compatible, could be successful, and that (2) if such a transplant were performed, the child's medical condition would be improved.

So, do you agree or disagree with my argument that it shouldn't be judges and lawyers deciding these protocols? It should be doctors, objectively considering the facts, determining the protocols to give donated organs to the BEST matches, with the BEST chances of long-term survival?
In general, yes.
Protocols are developed. A person or people are free to take that to court if they believe them to be arbitrary or unfair - which happens in various fields and industries throughout society. If they can demonstrate through evidence that the standard has an unfair impact that isn't justified by the merits, just as in any other field, then the judge can intervene and strike the standard. The judge should not write a new standard because the judge doesn't have the background, but if the parties are able to show that the existing standard is not medically supported, I don't mind them striking it. Given the time constraints and the potential impact, I don't mind if the judge says that the party filing the complaint should be treated as though that specific protocol did not exist until the standard can be reviewed and adjusted. I don't support saying that the person must be moved to the top of the list automatically, but I would support saying to place her on the list wherever she would fall without the standard that has been shown not to be medically supported.

Yup, this, I tried to rep yah but the wand has given out for today.
The transplant system has worked and has been in place for decades and now it has been destroyed. It will be for those who have money for a good lawyer or a good story.
So then can pediatric lungs be used in adults... It should go both ways.
