You don't give up all your rights when you accept employment.
Of course your rights are limited with a private company, but not entirely.
You have zero constitutional protections when it comes to your employer, or if you are on any form of private property. The constitution only applies to government, the first amendment does not exist within the confines of private property.
If you don't speak Spanish then how in the hell are you going to interview, hire and direct someone who doesn't speak English ?

I had a situation occur in school. New transfer student 2 weeks before school ended in 8th grade.
Didn't speak a word of English. There is no bilingual past 5th grade and there are no translators for classrooms. He spent the 2 weeks talking with other Hispanic students. I have no clue about his Math ability. Is this our future ?
Exactly! An employer has the right to insist on English being spoken while on the clock. My wife worked at a place that had such a policy but the exceptions were breaks and lunches. A memo was put on the board about it and some Hispanic ripped it off the board. All employees were required to be able to speak English before being hired so just what was the problem other than sheer arrogance?

Well I am from the Austin area and hearing Spanish being spoken was common place growing up. I don't see why people see this as some sort of threat against those who speak or only understand English? Hearing Spanish being spoken in Texas is as Texan as football. Whole Foods may be HQ'ed out of Austin, but that don't mean they are Texan. Two thumbs down for these clowns.
I think if you are here you should speak English. I don't see what's the problem. I find it offensive not to. Yet they want to scream & cry discrimination when they discriminate themselves from us.
ACLU needs to pick their battles a little better. Haven't there been cases like this before? I had a male friend once who worked for a US passport office who dressed up like col Sanders to go to work. He was eventually let go. I suspect that it was one thing that added to their case. An employer usually has standards that employees must follow.
Its really the fault of companies who started putting things in Spanish in the first place. Dont give them the option to continue a phone call in spanish, or read something else in Spanish. Make them adapt.
If I were moving to another country and intended on staying there a while, I would learn the language. Dont whine and complain that you arent catered to because you dont want to learn the main language of the country

And this incident happened in New Mexico, where Spanish is one of the de facto official state languages.
Seems to me that if a business wants to operate in a particular state, they probably want to do their due diligence regarding what is considered fair and/or usual practice in that state.

""I'm glad they are willing to re-evaluate that policy because I think every state is different," Martinez, a Republican and the nation's only Latina governor, said Friday after speaking to a constituent in Spanish.
The Spanish language "is part of the fabric of what makes New Mexico great," she said.
That being said, since Whole Foods has already changed their policy, I don't see this complaint going very far.
But who knows.
