As the State prepares to rest its case against George Zimmerman as early as tomorrow, I can’t help but juxtapose where we ought to be in terms of the weight of evidence of Zimmerman’s guilt of second degree murder, and contrast it with where we are. The gap is of Grand Canyon proportions. The Charge: Second Degree Murder

First, it is worth recalling that Florida’s second degree murder statute requires that Zimmerman have possessed a “depraved mind” when he killed Trayvon Martin. This is real simple. Citizens of Sanford Florida and the family of Trayvon Martin believe that a criminal wrong had been committed in the death of their son. The police and subsequently the state attorney felt that the evidence as they saw it did not meet the standard that that office had set to bring the case to trial.
The Citizens of Sanford and the Martin family believed that such a determination should not be left up to the discretion of the Sanford Police Department or the Seminole County State's Attorney's Office but rather should be put before an finder of fact i.e., a judge and a jury.
In order to achieve that result the Citizens of Sanford and the Martin family proceeded to develop a nation wide outcry for justice as they saw it. Subsequently a special prosecutor was appointed and it was determined by that special prosecutor that there was sufficient probable cause to prosecute the case, and three judges agreed....
