Show me where it says you can shoot to death What about 12, 10 and 8- year-old? who trespasses on private property.
Do you realize how often this occurs? Have you never had a neighbor's kid run across your lawn or cut through your back-yard? I mean, where do you people live?---Gestapo-land?
"What about 12, 10 and 8- year-old?" It is nice to be a Monday morning quarterback. The property owner did NOT know if the kid was armed or not.
"It is better to be judged by 12 then carried by 6".
In many states like TX it makes a difference if it's day or night. There is a presumption of higher danger after dark;
Sec. 9.42. DEADLY FORCE TO PROTECT PROPERTY. A person is justified in using deadly force against another to protect land or tangible, movable property:
(1) if he would be justified in using force against the other under Section 9.41; and
(2) when and to the degree he reasonably believes the deadly force is immediately necessary:
(A) to prevent the other's imminent commission of arson, burglary, robbery, aggravated robbery, theft during the nighttime, or criminal mischief during the nighttime; or
(B) to prevent the other who is fleeing immediately after committing burglary, robbery, aggravated robbery, or theft during the nighttime from escaping with the property; and
(3) he reasonably believes that:
(A) the land or property cannot be protected or recovered by any other means; or
(B) the use of force other than deadly force to protect or recover the land or property would expose the actor or another to a substantial risk of death or serious bodily injury.
I am on the side of the kid... Yes, he is a thief but i think the homeowner should try something other than lethal force as the FIRST action... If the kid charged at the homeowner or attacked then I would side with the homeowner but that did not happen... I still think Zimmerman is not guilty... He was attacked first, end of story...
BUT, the "kid" made a move. How do you know he wasn't reaching for a gun?
The court system is repleat with people who think they know the law. This is just another case of what somone thought they knew and the actual law not being the same.
Not only did he kill someone, now he is in a whole lot of crap.
