Flac uses lossless compression and is no different than WAV other than smaller files.

Your last WAV is identical to the first one. That said I'm not sure what purposely degrading a file has to do with this.
It has everything to do with it... it isn't a 1:1 copy if you rip a CD to MP3. Which most people do. Filesharing of audio and video files are transferred, virtually, through compressed formats.

Let's touch on something else, copyright is also meant to protect the integrity of a work. e.g you can't compromise it such as degrade it and then present it as the original work.
