It should not be the landlords' and/or building mgmt.'s responsibility to provide clean air to tenants. Smokers are the problems in buildings and the onus should be totally on them. Most important is that laws must be enforced and the violators given stiff penalties. Just as there are more and more laws prohibiting smoking in places of employment, there should be likewise so that normal, healthy people can rent out apartments without having to become victims of second-hand smoke. I see no difference between being forced to breath in fumes from leaky gas pipes and other forms of toxicity, and being forced to breathe in second-hand smoke. I am including pot. The local and federal health dept.s have been extremely tardy in making it possible for normal, healthy people to live in apartment buildings without having to become victims of second-hand smoke. This includes apartment building which rent out to Section 8 / subsidized tenants.

If you don't want neighbors who smoke, then don't rent in a building that allows smoking.

Good. There should be less laws against smoking. This isn't a dictatorship. Smoking is legal and if you want to do it, then you should do it. If an individual landlord, business owner, restaurant owner, or whoever doesn't want smoking on their private property then fine. If they do, then fine. If you don't like it, then go somewhere else and take your moralizing with you.

What if they're smoking marijuana which is being legalized in so many places? How are you going to tell them they can't smoke it if it's legal?

That's not good enough. People 3,000 miles away can't be allowed to smoke either. This is how the anti-freedom nuts think.

Any attempt to control a person's behavior inside a dwelling through laws and legislation only opens the door to more restriction outside of the dwelling. So what would happen, would they put a detector in the apartments to monitor air quality? If it went off, would the police be called and come to your house to write you a citation, because you are doing something illegal. That would be reason enough for them to search your dwelling without a warrant, it's obvious you have been committing a crime! Let's especially suggest this be enforced in Section 8, we all know they have those luxurious balconies to hang out on so it's not like they would be hanging out on the street or anything, especially in the metropolitan areas where crime is already sky high.

What a dumb suggestion. I then purpose that we shut off the OP's access to the internet, it's apparent that he/she cannot use it responsibly and besides, would be better off saving for an air purifier.

then wouldn't the converse be necessary? You would have to have a place where non smokers could go.

I have happened to stumble across many rental ads where they specify that the house or building is smoke free. It's not too difficult.

Last time I checked cigarettes were legal! Cut the nanny state BS, or move your a** to some Communist country!

I agree. I wish people would quit being busy bodies and stop telling people what they should or shouldn't do with their bodies, or what they consume!

I propose we deport all of the authoritarian types in this country, who think that they can control others behaviors. I hear the weather in Iran is pretty good this time of year! Bunch of busy bodies!

Once something like this passes then they will outlaw BBQ, them after that you won't be able to cook with a gas stove, only electric; after all, it is for the children.
