What about those who are found to be mentally ill? They don't give up rights like convicts.
If they're found to be legally mentally incompetent they can. If they are a danger to themselves or others then they can be involuntarily committed. The framework is in place to file those proceedings with NICS, there is no reason to assume that people so committed should not have their homes searched for weapons, indeed depending on the illness that may be a requirement for them to be released.
Virginia was censured during the VA Tech hearings, as they had not performed their responsibilities to file Cho's mental health records with NICS. Had they performed these responsibilities Cho would never have been cleared to buy a firearm from a licensed dealer.

Ok...all you New Yorkers had the opportunity to send me your New York illegal firearms, magazines, ammunition, and firearm accessories before this came down...
Told you all that I, (and other Alaskans), would have taken excellent care of your contraband firearms and accessories. I would have exercised them, kept them clean, and I even offered to let you come visit them here in Alaska. I was even willing to provide transportation to the range.
